Challenges in the daily practice ofcross-border legal cooperation within​the European Union: EU surveys report

Abstract

The document presents an analysis of 2 European Union (EU) surveys carried out between June and July 2023. More concretely, the first survey was aimed at the competent authorities (judges, prosecutors and other authorities) for the application of Framework Decision (FD) 2008/909 (on the application of the principle of mutual recognition to judgments in criminal matters imposing custodial sentences or measures involving deprivation of liberty for the purpose of their enforcement in the EU) and, eventually in reference with FD 2008/947 (on the application of the principle of mutual recognition to judgments and probation decisions with a view to the supervision of probation measures and alternative sanctions) and FD 2009/829 (on the application, between Member States of the EU, of the principle of mutual recognition to decisions on supervision measures as an alternative to provisional detention).

The second survey targeted lawyers and professionals in the penitentiary environment, as well as similar practitioners in what concerns their role in the implementation of FD 2008/909.

The surveys collected 133 answers, covering 20 EU jurisdictions: 83 responses in the first survey (covering 16 jurisdictions), and 50 in the second (covering 11 jurisdictions).

The gathered information offered a comprehensive perspective, enriched by valuable insights, and complexities associated with FD 2008/909 and its implementation in reference with the abovementioned FDs in criminal matters.
